Scope of Services

T.M.I Designs & Staging provides professional staging, interior design, creative consulting, and custom art services. All services are tailored to each client and governed by an individual contract or written agreement outlining scope, timelines, and fees.

Any services not expressly stated in a signed agreement are not included.

Contracts & Client Agreements

  • All clients are required to sign a contract prior to the commencement of services.

  • Contracts are created on a per-client and per-project basis.

  • Signed contracts supersede any verbal discussions, emails, or social media communications.

  • Changes to scope, deliverables, or timelines must be approved in writing and may result in additional fees.

Payments, Retainers & Fees

  • A non-refundable retainer or deposit may be required to secure services.

  • Full or partial payment may be required prior to project commencement.

  • All fees are non-refundable unless otherwise stated in writing.

  • Late payments may result in paused services, project delays, or termination.

T.M.I Designs & Staging reserves the right to withhold deliverables until outstanding balances are paid in full.

Cancellations & Termination

  • Client-initiated cancellations do not qualify for refunds.

  • If services are terminated after work has begun, the client remains responsible for all work completed to date.

  • T.M.I Designs & Staging reserves the right to terminate services for breach of contract, non-payment, lack of communication, or inappropriate conduct.

Client Responsibilities

Clients agree to:

  • Provide accurate information, measurements, access, and approvals in a timely manner

  • Maintain safe, accessible work environments

  • Secure valuables, pets, and personal items prior to staging or installation

  • Obtain necessary permissions, HOA approvals, or property access authorizations

T.M.I Designs & Staging is not responsible for delays caused by incomplete or inaccurate client-provided information.

Artistic Discretion & Subjectivity

Design, staging, and art services are inherently subjective. By engaging T.M.I Designs & Staging, clients acknowledge and accept artistic discretion, professional judgment, and creative interpretation.

Dislike of style, personal preference changes, or subjective dissatisfaction does not constitute grounds for refunds.

Intellectual Property

All designs, concepts, layouts, renderings, artwork, photographs, and content created by T.M.I Designs & Staging remain the intellectual property of T.M.I unless otherwise agreed in writing.

Clients may not reproduce, distribute, sell, or modify any work without written permission.

T.M.I Designs & Staging reserves the right to photograph completed projects and use images for portfolio, marketing, website, and social media purposes unless otherwise agreed in writing.

Third-Party Vendors & Purchases

T.M.I Designs & Staging may coordinate with third-party vendors on behalf of clients. We are not responsible for vendor delays, defects, shipping issues, or policy limitations.

All third-party purchases are subject to vendor terms, warranties, and return policies.

Limitation of Liability

To the fullest extent permitted by law:

  • T.M.I Designs & Staging shall not be liable for indirect, incidental, consequential, or special damages.

  • Total liability shall not exceed the amount paid by the client for the specific services giving rise to the claim.

  • We are not responsible for property damage caused by pre-existing conditions, structural issues, or client-provided items.

Indemnification

Clients agree to indemnify and hold harmless T.M.I Designs & Staging from any claims, damages, losses, or expenses arising from:

  • Client breach of these Terms

  • Inaccurate information provided by the client

  • Third-party vendor actions

  • Property access issues or unsafe conditions

Website Use

You agree not to misuse our website or attempt unauthorized access to systems, content, or data. All website content is provided for informational purposes only and may be updated without notice.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the state in which T.M.I Designs & Staging operates, without regard to conflict of law principles.

Changes to Terms

T.M.I Designs & Staging reserves the right to update these Terms at any time. Continued use of services constitutes acceptance of updated Terms.
